It happens ALL the time during and after a wind storm. An insured calls and says one of his /her trees has fallen on their neighbor's house, fence or out building. My response is an unpopular one; have your neighbor contact his/her insurance company. If a tree falls due to wind, it is considered an "Act of God". Many people feel responsible for their tree and want to help in some way. I always tell insureds that if it had been covered they would have had a deductible, so they may want to help their neighbor pay their deductible. The only time the tree owner's policy would be activated is if the tree owner knew the tree was diseased and had a potential to fall in heavy winds.
